Applicable Terms and Conditions for Clients Who Have Made an Individual Tourist Accommodation Reservation at THE O
Check-in and Check-out Policy
Check-in time is at 3:00 PM and check-out time is at 1:00 PM.
Early Check-in
If you need to check-in before the established time, early check-in is subject to availability, and the guest must pay between 50% and 100% of the full rate.
Late Check-out
If the guest does not check-out after 1:00 PM without prior communication to reception about any situation preventing check-out, they must pay between 50% and 100% of the full rate.
Pricing Policy
a) The published rate corresponds to the value per night per room, with an additional charge for extra guests, which must be requested in advance of the guest’s arrival.
b) The rate does not include the Value Added Tax (VAT) of 19%, which applies to tax residents in Colombia in compliance with Decree 2646 of 2013.
Reservation Policies
a) Reservations are guaranteed with full prepayment.
b) Only in cases of force majeure or demonstrable fortuitous event by the guest, the accommodation will consider the possibility of a refund, applying a penalty for the charge of the first night and administrative costs.
c) In case of overbooking, the accommodation reserves the right to relocate the guest to another establishment of equal or superior category, or proceed with a full refund of the amount paid for the reservation.
Cancellation Policy
a) The guest can cancel their reservation up to 24 hours before the arrival date without penalty. After this period, the corresponding amount for a daily rate will be charged, which cannot be exchanged for credit for future stays.
b) Full payment or a debit equivalent to the total nights plus taxes is required as a deposit for the reservation.
c) In case of a no-show without prior cancellation or modification within the established period, a penalty will be applied and the deposit will be deducted.
d) Date changes are allowed, subject to availability and prior payment of the fare difference for the new dates, if applicable.
e) Early departure without justified reason will result in the charge of the remaining amount of the accommodation and the daily rates paid will not be refunded.
Policy for Minor Guests
For safety reasons related to the accommodation’s facilities, guests under 16 years of age are not allowed.
a) All guests under 18 years of age must be accompanied by their parents or a legally responsible adult who can guarantee their relationship with the minor. If accompanied by a third party, a signed letter from both parents authorizing the accompaniment is required. If one parent is absent, supporting documentation must be attached.
b) In strict compliance with Article 17 of Law 679 of 2001 and Law 1336 of 2009 on the prevention of exploitation, pornography, and sexual tourism with minors, THE O rejects and denounces any suspicious behavior in this area.
Policy for Additional Guests
a) The accommodation service for additional guests will only be provided in rooms with suitable accommodation features.
b) The accommodation of additional guests is subject to prior registration at reception and payment of the corresponding fee.
c) THE O reserves the right of admission, in accordance with our company’s policies.
Payment Methods
a) Available payment methods to formalize your reservation are cash, debit and credit cards, PSE, and bank transfer.
b) Foreign currency payments: The rates at THE O in Colombia are in Colombian pesos. The accommodation is not responsible for fluctuations caused by payments in foreign currency.
c) Cheques are not accepted.
Reversion Policy
a) If you book our services through our channels and use a credit card, debit card, or any other electronic payment method, and the payment method used is issued by a financial institution domiciled in Colombia, our company will request the payment reversal from your bank, deducting the respective administrative charges by law within 30 days.
b) Authorize our staff to make an instant reversal in case of a malfunction with the card terminals, in order to correct the incorrect charge made to your card.
Code of Conduct
The GUEST agrees to comply with the instructions and policies of the ACCOMMODATION and to maintain behavior that does not disrupt coexistence and public safety throughout their stay, in accordance with the law.
Parties, loud music, and noise that disturbs the peace of other guests are prohibited. Non-compliance may result in a fine of up to USD $150 or the equivalent in Colombian pesos.
The accommodation is not responsible for objects forgotten or lost in common areas, as this is the guest’s sole responsibility.
Found objects will be kept for 30 days and then donated to charity or discarded.
Unregistered visitors are only allowed in the lobby on the ground floor.
Wearing swimwear or going shirtless in the hotel’s common areas is prohibited.
Towels should not be taken from the apartments for external use.
Anti-Tobacco Law:
In compliance with Law 1335 of 2009, our building is smoke-free. Therefore, guests must refrain from smoking in designated non-smoking areas, as well as in enclosed areas such as rooms, corridors, restaurants, and lounges. Non-compliance will incur a fine of USD 100 or the equivalent in Colombian pesos.
Guests are responsible for maintaining the rooms in good condition. Excessive mess or any other type of odor will result in a fine.
Anti-Corruption Commitment
Local and international legal provisions on anti-corruption prohibit paying, promising, or authorizing the direct or indirect payment of money or any item of value to any public official, government employee, political party, candidate, or person acting on behalf of a public entity when such payment implies a corrupt intention to obtain a benefit. Non-compliance with this policy may result in compensation for all damages caused, and SEEKERS SAS will have the right to terminate the corresponding relationship immediately without penalty or compensation.
Privacy Policy
a) The accommodation undertakes to ensure the privacy and security of its guests throughout the browsing and purchasing process on the website. Guest registration data will not be sold, exchanged, or disclosed to third parties, except when necessary for delivery, billing, or participation in promotions requested by guests.
Authorization for the Processing of Personal Data
Pursuant to Law 1266 of 2008, Law 1581 of 2012, Decree 1377 of 2013, and Decree 886 of 2014, among other regulations, the client authorizes THE O and/or its affiliates, as applicable, to process their personal data. This includes collection, storage, use, circulation, suppression, updating, transmission, and transfer, in accordance with the policies published on our digital platforms. Acceptance of the General Conditions
The CLIENT declares their acceptance of these general contracting conditions. Such acceptance is confirmed by any of the following actions:
a) The accommodation contract is accredited by the Accommodation Registration Form issued by the ACCOMMODATION, signed by the GUEST, confirming compliance with the stipulations contained herein.
b) The GUEST expressly agrees that the amount indicated on the invoice will be valid as a claim.
